A permanent resident is someone who has been given permanent resident status by immigrating to Canada, but is not a Canadian citizen. Permanent residents are citizens of other countries.

There are multiple programs in which a person can obtain Permanent Residence.

express
entry

The Government of Canada resumed Express Entry draws in July 2022. They have also proposed changes to the express entry system, moving towards a NOC based draw system. 

Express Entry is a selection system for Canadian immigration, designed to select skilled workers for immigration to Canada through three different programs. It is a completely electronic process that manages the application process and is meant to streamline the application process. Potential applicants are awarded up to 1200 points in the Comprehensive Ranking System (CRS). The government uses factors such as age, education, language, adaptability and work experience. An invitation to apply (ITA) for permanent residence is given to those based on the criteria of each draw.

Canadian Experience Class (CEC) is designed for skilled workers who have gained one year of work experience in Canada in the 3 years prior to applying.
Foreign Skilled Worker (FSW) is ideal for workers who have gained their experience outside of Canada. You must meet minimum requirements for language, work experience and education.
Federal Skilled Trade (FST) is a category for foreign nationals who possess experience in a skilled trade. A valid job offer or a certificate of qualification is necessary.

provincial
nomination 
 

Provinces and territories have their own “streams” (immigration programs that target certain groups) and requirements. For example, in a program stream, provinces and territories may target student, business people, semi-skilled workers or skilled workers. How you will apply depends on which Provincial Nominee Program stream you’re applying to. To be nominated, you must follow the program requirements specified by each province.

This program is for workers who have the skills, education and work experience to contribute to the economy of a specific province or territory, want to live in that province, and want to become permanent residents of Canada.

family
sponsorship

 

Permanent Residents or Canadians who wish to sponsor a family member for Permanent Residence will choose this category. It is important to remember that not just any member of the family can be sponsored, they must meet the definition of family as prescribed in the family class.

Canadian citizens or permanent residents of Canada can sponsor the following members of their family:  spouse, common-law partner or conjugal partner (opposite or same-sex), dependent children, parents, grandparents, children adopted from abroad, and under specific circumstances, other relatives.
If you sponsor your spouse, common-law partner or dependent child, you must be able to support the person financially and ensure they will not require asocial assistance.

If you sponsor a parent or grandparent, you must meet minimum income requirements and be willing to sign an undertaking agreement.

humanitarian and
compassionate grounds

 

Canada's Immigration laws provide the flexibility to grant permanent residence status or a permanent resident visa to certain foreign nationals who would otherwise not qualify in any class, in cases in which there are compelling H&C grounds.
 


 

Officers will base their decisions on H&C applications based on relevant factors including, but not limited to

  • establishment in Canada for in-Canada applications;

  • ties to Canada;

  • the best interests of any children directly affected by the H&C decision;

  • factors in their country of origin, including adverse country conditions;

  • health considerations including inability of a country to provide medical treatment;

  • family violence considerations;

  • consequences of the separation of relatives;

  • inability to leave Canada has led to establishment (in the case of applicants in Canada);

  • ability to establish in Canada for overseas applications;

  • any unique or exceptional circumstances that might merit relief

If you are not eligible for other categories of permanent residence, but believe you would experience unusual and undeserved or disproportionate hardship if you were required to leave Canada, this type of application may be for you.
